Road Closure – Drimnin Road – May 15 – June 1 2023

Update today May 12  From Highland Council

To keep you updated, we will not be commencing on the 15th May as planned. We have encountered some technical issues that can hopefully be resolved and if so we are aiming to start week commencing 22nd May (weather permitting – we can’t Surface Dress in the rain).

In the interest of health and safety of our workers we carried out a site specific risk assessment and there are not enough adequate safe places for the Surface Dressing plant to pull off the road and let cars through. We have also made special  arrangements for the school transport driver and local transport office has  been informed by email. I have also informed the driver  that if its raining there will be no restrictions in place – as previously explained we can’t surface dress in the rain.

THE HIGHLAND COUNCIL (TEMPORARY PROHIBITION OR RESTRICTION ON ROADS – B849  LOCHALINE – DRIMNIN ROAD), NOTICE 2023 

The Highland Council in exercise of the powers conferred on them by Section 14(1) (b) of the Road Traffic  Regulation Act 1984, as amended, and related legislation, as amended, hereby make this Notice. 

  1. Citation, commencement, and cessation 

This Notice may be cited as ‘The Highland Council (Temporary Prohibition or Restriction on Roads – B849  Lochaline – Drimnin Road) 2023’ It will come into operation between Monday 15th May 2023 until Friday 1st June 2023 (Monday-Friday). However, the restrictions will not be in place in any wet/adverse weather  conditions making it unsuitable for us to carry out the road works or if we have completed the works  before the 1stJune 2023.

Throughout that period, the use by vehicles of the length of road specified in the Schedule hereto except for  use by emergency services is prohibited.  

  1. Interpretation 

The Interpretation Act 1978 shall apply for the interpretation of this Notice as it applies for the  interpretation of an Act of Parliament. 

  1. Expressions and meanings 

The following expressions will have the meanings hereby respectively assigned to them: ‘Vehicle’ means a motorcycle or motor vehicle constructed solely for the carriage of passengers and  their effects: 

‘Emergency Vehicles’ means a motor vehicle constructed or adapted for use by the Police, Ambulance Service, Fire Brigade or Her Majesty’s Coastguard: 

  1. Relationship to other Orders 

All provisions contained in any Order Enactment or others in so far as the same repeat or are  inconsistent with the provisions of this Notice and the true intent or meaning hereof shall cease to have  effect, during the period stated hereto. 

  1. Reason 

The Highland Council’s Roads Authority are satisfied that traffic on the road should be restricted or  prohibited because of the likelihood of danger to the public, or of serious damage to the road, which is  not attributable to such works that are being or are proposed to be executed on or near the road  specified in the Schedule to this Notice.

  • Blue light, Emergency Service vehicles will be permitted access at all times. 
  1. Temporary prohibition on use of a road 

No person shall drive, or cause or permit any Vehicle to be driven on the length of road, or a part or  parts of the length of road, specified in the Schedule to this Notice when a prohibition is identified as  applying to the whole or a part or parts of the length of road by means of one or more of the traffic  signs prescribed in Diagram 7105 of the Traffic Signs Regulations and General Directions 2016(b).
